Warranty
U.S. Liner Company (the “Company”) provides
this warranty solely for the benefit of the original purchaser of
Bulitex and Versitex “Products” and is not transferable.
U.S. Liner Company warrants that “Products”
will not rust or rot. These warranties are provided on the interior
lining panels for two (2) years from the date of purchase. However,
no warranty shall be valid, and purchaser shall have no claims against
the Company for any defects or failures which arise as a result
of purchaser’s failure to use the Products for their intended
purpose and in strict compliance with any instructions provided
by the Company or the manufacturer of the vehicles in which the
Products are installed. Any repair materials and/or replacement
panels supplied pursuant to this Warranty must be installed by a
professional and in accordance with instructions provided by the
vehicle manufacturer or the Company.
Cost of fabrication and installation is not covered
by this Warranty. To preserve the rights given under this Warranty,
the original purchaser is obligated to properly maintain the vehicle.
This Warranty does not cover damage or loss: (a) due
to occurrences which are force majeure in nature such as, by way
of example, catastrophic events such as a tornado, snow burial and
flood, among others; (b) damage due to accident, negligence, vandalism,
misuse, or damage incurred to the vehicle prior to the original
purchase; or (c) incidental, consequential, or punitive damages.
In the event of a claim with respect to the Product,
please call or write U.S. Liner Company, Quality Assurance Manager,
19 Leonberg Rd. Cranberry Twp., PA 16066; Phone 1-800-USLINER (875-4637).
Upon notice of a claim which has been substantiated by the Company
as falling within the terms of this warranty, the Company has the
option to repair or replace the Panel incorporating the Product;
or to refund the purchase price of the Panel.
The foregoing warranties are the only warranties of
the Company and no other warranties are given hereby either express
or implied or by operation of law with respect to its Products and
such warranty is expressly limited to the terms hereof. No warranties
are given by the Company with respect to any other component of
the vehicle. The Company’s aggregate liability for all claims
hereunder, if any, shall not exceed an amount equal to the total
amount of the repair or replacement costs of the Product.
THE COMPANY DISCLAIMS ANY WARRANTY, EXPRESSED OR IMPLIED,
WHICH IS NOT CONTAINED HEREIN, INCLUDING ANY IMPLIED WARRANTY OR
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT
SHALL THE COMPANY BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL
OR PUNITIVE LOSS, SPECIAL OR EXEMPLARY DAMAGES OR EXPENSES (INCLUDING
LOST PROFITS AND SAVINGS) PURSUANT TO THIS AGREEMENT, EVEN IF THE
COMPANY HAS BEEN ADVISED OF SUCH DAMAGES, INCLUDING, BUT NOT LIMITED
TO LOSS OF REVENUE OR ANTICIPATED PROFITS, OR LOST BUSINESS.
